§ 22-90. Fees, inspections, and appeals.

  • (a)

    Fees. Fees for inspections and appeal shall be adopted by City Council by separate ordinance.

    (b)

    Appeals. Appeals are made directly to City Council per Ordinance [No.] 100-04-09, § II, #2.

    (c)

    Repeal of conflicting ordinances. In matters of safety to life and property from fire, this article shall prevail. All ordinances or former ordinances, or parts thereof conflicting or inconsistent with the provisions of this article or the NFPA Fire Prevention Code hereby adopted are hereby repealed.

    (d)

    Penalties for violation. Any person, corporation, partnership, association, or joint venture violating any of the provisions of this article shall be guilty of a class C misdemeanor punishable by a fine of not less than $100.00 nor more than $2,000.00 or by imprisonment not exceeding 30 days, or both such fine and imprisonment. Such fine and imprisonment shall be at the discretion of the city judge. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

    (e)

    Copy of article on file. The Office of Fire Prevention of the City Fire Department shall keep one copy of this article and supporting NFPA standards, specifically the NFPA Fire Prevention Code, and may be reviewed during normal business hours.
